Terms and conditions SL CONCEPT FITNESS S.A.
This document represents an adhesion contract proposed by SL CONCEPT FITNESS S.A. and which must be accepted before ordering any product or service. Any order confirmed by the customer, by checking the box under the Terms and Conditions and by pressing the “I agree” button and payment for the product is an acceptance by the customer of the offer SL CONCEPT FITNESS SA, under the conditions stipulated by art. 9 of the Electronic Commerce Law 365 / 2002. The click on the “I agree” button represents an electronic signature, in the sense of art. 3 point 10 of the EU Regulation 910/2014, having the same value with a holographic signature.
The mentioned Terms and Conditions refer to SL CONCEPT FITNESS S.A., headquartered in Bucharest, sector 2, Sos. Fundeni, no. 159, 1st floor with an area of 935 sqm. and the 2nd floor with an area of 980 sqm, Romania, registered at the Trade Register under no. J40/1077/2020 and having the Unique Identification Code 42175040.
These Terms and Conditions will govern your use of this site, which can be accessed at www.wowgym.ro.
Introduction
Certain personal data are collected through the SL CONCEPT FITNESS website. Details on the processing of this personal data are available in the Privacy Policy.
1. Definitions
SL CONCEPT FITNESS: SL CONCEPT FITNESS S.A based in Bucharest, sector 2, sos. Fundeni, no. 159, 1st floor with an area of 935 sqm. and the 2nd floor with an area of 980 sqm, Romania, registered at the Trade Register under no. J40 / 1077/2020 and having the Unique Identification Code 42175040, email address: ——. Ro, company that manages www.wowgym.ro.
Product: any product or service that can be purchased by a customer through the website.
Customer: natural or legal person who places an order on the site.
Order: the purchase order of one or more products and / or services displayed on the website, made by a customer.
2. The object and acceptance of this sales contract
This contract is applicable to all orders placed through the www.wowgym.ro. The customer undertakes to take note of these conditions before placing an order. All orders imply acceptance of all these conditions of sale by the customer. The acceptance of this contract by the customer is done by reading the Terms and Conditions and checking the box “I agree”. SL CONCEPT FITNESS reserves the right to modify, add and delete parts of the Terms and Conditions, at any time and without prior consent and at our discretion. The version applicable to an order is the one in force on —- at the time the order was placed by the customer. Check and read our Terms and Conditions periodically to be aware of any changes. If you do not agree to these terms, you will not use our website and cancel any future subscriptions.
3. Availability of the displayed products
Our offer regarding the products and their price is valid as long as it is displayed on ——-. In case of an express period of validity of a certain price, this aspect will be specified specifically on the page of the respective product / subscription.
4. Products and services displayed on the website. Limitation of liability
This website offers products and services including Healthcare, fitness training, exercise and sports and are the creation and property of SL CONCEPT FITNESS S.A. But we must inform you that the products and services are intended for healthy people. If you have health problems, physical deficiencies or other problems that could be affected or aggravated by exercise, regardless of the degree of difficulty, we recommend that you consult a doctor or other specialist for personalized advice. Our programs are designed and created as general recommendations for improving the tone and cannot replace specialized diagnoses or approved medical opinions, which are based on the individual consultation of people. Thus, we emphasize that all the information, recommendations, advice and exercises proposed are not intended as medical recommendations and cannot replace the recommendations of doctors or specialists, but are general information for a healthy lifestyle. Also, the food content is not intended for people suffering from various allergies, food intolerances, etc. We advise you to consult with your doctor before making major changes in your diet and lifestyle. SL CONCEPT FITNESS assumes no liability, under any circumstances, for any damage, directly or indirectly suffered as a result of the use of its products or services or the lack of information and services provided by the site, if they were used contrary to the provisions and information transmitted by these terms and conditions.
5. The price
The prices shown include VAT. The prices presented are valid until their revocation, once they are delisted from the website. Also, if we are talking about a promotional campaign, you must know that the price of the product, presented online, is valid only for the specified period. In case of an express period of validity of a certain price, this aspect will be specified
on the respective product page. In case of displaying an erroneous price, we will take all measures to remedy the error as soon as possible. If the price will be below 25% of the normal value of such a product, it will be considered frivolous and derisory, according to art. 1665 of the Civil Code, and any order made on the basis of this price will be canceled.
6. Personal Data and Confidentiality
SL CONCEPT FITNESS collects your personal data exclusively for the purpose of providing SL CONCEPT FITNESS products and services, (with all related activities such as order processing, payment, invoicing, etc.) customer service and marketing activities for your own needs services customer relations and marketing activities for their own needs. According to the legislation in force, you benefit from the right of access, intervention on personal data, the right not to be subjected to an individual decision and the right to go to court. At the same time, you have the right to object to the processing of personal data concerning you and to request the deletion of personal data collected by us. When you access SL CONCEPT FITNESS or when you create an account we can ask you for your name, surname and / or email address. We may also optionally ask you for other personal information – such as date of birth, height, weight, type of physical activity so that we can send you personalized information, such as exercise or estimated caloric needs.
7. Payment Methods
• Payment will be made using the bank card, by POS, at the cashier at the reception of SL Concept Fitness SA or online. If the payment is made by any means that involves a certain banking operation (debit / credit card, etc.), the payment is considered validly made from the moment the bank account of SL Concept Fitness SA is validly credited and unequivocally with the amount representing the equivalent value of the payment obligation.
• In the case of contracts concluded online, payments can be made using a credit / debit card, through a dedicated internet payment service. SL Concept Fitness SL is operated by the dedicated internet payment service – PayU, a processor that will use and retain the card data.
• For recurring payments, PayU will use and retain the card data used for as long as the recurring payment remains active. The time of billing will coincide with the expiration of the subscription validity period, as long as the recurring payment is not deactivated. If the deactivation of the recurring payment by the Member is omitted and the amount is processed, SL Concept Fitness SA will not be held liable and will not return the amount of the amount. The recurring payment may be canceled from the member’s account or by calling the reception, at least 5 days before the end of the contract’s validity and at the latest, on the last day of validity.
8. Strong major
SL CONCEPT FITNESS, its partners or users cannot be held responsible for any delay or error in the execution of contractual obligations or in the content provided on our site, resulting directly or indirectly from causes that do not depend on the will of SL CONCEPT FITNESS. This exemption includes, but is not limited to: malfunctions of the technical equipment from SL CONCEPT FITNESS, failure of internet connection, failure of telephone connections, computer viruses, unauthorized access to SL CONCEPT FITNESS systems, operating errors, strike, etc.
9. Other provisions
A. Newsletter
SL CONCEPT FITNESS does not send unsolicited commercial communications, in accordance with the Romanian legislation in force. SL CONCEPT FITNESS reserves the right to send commercial messages regarding its activities and those of its partners to the e-mail addresses with which you have registered in order to have access to the SL CONCEPT FITNESS services or to the SL CONCEPT FITNESS newsletter. These will be clearly identified as coming from SL CONCEPT FITNESS and will have the possibility of free dissubscription.
B. Links to other sites
SL CONCEPT FITNESS is not responsible for the content, quality or nature of the sites reached through links on this site (links of a commercial or advertising nature). The responsibility for these sites lies entirely with their owners.
C. Changes to the site or application
SL CONCEPT FITNESS reserves the right to suspend, modify, add or delete portions of its content at any time. SL CONCEPT FITNESS also reserves the right to restrict users’ access to some or all of its content.
D. Your account
Registration on the SL CONCEPT FITNESS website is free. Your access to certain services and information within the site is allowed only to registered users, access being protected by a password. 10. Changing the terms
SL CONCEPT FITNESS reserves the right to change the terms without fulfilling other formalities. When these terms change, SL CONCEPT FITNESS will notify you via email or a message in your SL CONCEPT FITNESS user account and by posting on the first page of the site, a link referring to the new form of this document. Access to the site and / or use of our services after the moment of notification or display of the link regarding the changes on the first page of the site implies that you have agreed to the new terms.
11. Problem solving
If you have problems with an order that do not seem to be resolved by email or with the person you are talking to you can contact for a free internal conciliation at info@wowgym.ro. The European Commission also provides an ODR platform for the alternative resolution of disputes concerning the out-of-court settlement of distance contract issues. The ODR platform is available at http://ec.europa.eu/consumers/odr/ .
12. Disputes
Any dispute that may arise in connection with this website www.wowgym.ro will be settled amicably by the Parties.
In case a dispute cannot be settled amicably, the Parties may address the competent Romanian courts in Bucharest, according to the law.
13. Applicable law
The Terms and Conditions are available in Romanian and English, the rights and obligations of the parties, imposed by these terms and conditions, as well as all legal effects produced by this agreement will be interpreted and governed by Romanian law.
